Welcome to Left Brain Quilts ("we," "us," "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, products, and services (collectively, the "Site"). By using the Site or purchasing from us, you agree to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from us, or have permission from a parent/guardian.

3. Purchases, Payments, and Order Processing

·         Prices are shown in USD unless stated otherwise.

·         Payment must be received before delivery.

·         We may refuse, cancel, or limit orders at our discretion (e.g., suspected fraud, misuse, or policy violations).

4. Digital Products (Licensed, Not Sold)

Digital products (including quilting patterns, PDFs, templates, and instructions) are licensed, not sold. Your purchase grants a limited, non-exclusive, non-transferable license for personal use only, unless a separate written license (such as a Teaching License) is provided at purchase or by written agreement.

Our Pattern License is incorporated into these Terms by reference and governs permitted uses of Patterns and Digital Products. The Pattern License is available at: https://leftbrainquilts.com/license.

5. Prohibited Uses

You may not:

·         Share, distribute, upload, resell, or sublicense our digital files.

·         Post our pattern pages or templates publicly (including social media, groups, or file sites).

·         Sell Finished Items made from our Patterns unless you have a separate written agreement that explicitly allows commercial sales.

·         Use our Patterns to teach classes, workshops, retreats, guild programs, or create tutorials without a separate written Teaching License.

·         Attempt to bypass download protections or access restricted areas.

·         Use the Site for unlawful, abusive, or harmful activity.

6. Intellectual Property

All content on the Site (Patterns, text, graphics, photos, logos, and downloads) is owned by Left Brain Quilts LLC or its licensors and is protected by intellectual property laws. No rights are granted except as expressly stated in these Terms or in a written license issued by us.

7. User Content (Photos, Reviews, and Submissions)

If you submit reviews, comments, or photos to us (e.g., by email, forms, or social media tags), you grant us a non-exclusive license to use, repost, and display that content for marketing and community purposes, unless you ask us not to. You represent you have the rights to share what you submit.

8. Physical Products, Kits, and Safety

If we sell physical items (printed patterns, kits, tools, or supplies), you agree that quilting and sewing involve inherent risks, including the use of sharp tools, needles, rotary cutters, irons, and sewing machines.

·         Use all products safely and follow instructions.

·         You assume responsibility for proper use and supervision.

·         Instructions and patterns are provided for informational and creative purposes only and are not professional safety, medical, or instructional advice.

9. Shipping & Returns (Physical Goods)

If physical goods are offered, shipping times are estimates and may vary. Return/refund eligibility (if any) will be stated on the product page or our returns policy at the time of purchase.

10. Refunds

Digital Products: Due to the nature of immediate access and downloads, digital sales are final unless we state otherwise in writing or required by law.

Physical Products: Any return/refund policy for physical goods will be disclosed at purchase.

Access Issues: If you have trouble accessing a file, contact us and we will help.

11. Disclaimer of Warranties

The Site and products are provided "as is" and "as available." We do not guarantee that patterns, instructions, or results will meet every expectation, or that the Site will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product at issue.

13. Indemnification

You agree to indemnify and hold harmless Left Brain Quilts LLC from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of products, or violation of law.

14. Copyright Complaints

If you believe content on our Site infringes your copyright, contact us at the email above and include: your contact info, the work claimed infringed, the URL/location, and a statement that you have a good-faith belief the use is unauthorized.
